The rules and guidelines for using our services

These Terms of Service cover what you can expect from us and what we ask of you when you use eViRis Health. They apply to our website, app, and all services we provide. Please take a few minutes to read them — they're written to be straightforward, not buried in fine print.
Who Can Use eViRis Health
You need to be legally old enough to enter into a contract under Indian law. If you're under 18, a parent or guardian will need to use the platform on your behalf and accept these Terms for you.
Using Our Services
By using eViRis Health, you're agreeing to these Terms. If something here doesn't sit right with you, please don't use our services — and feel free to reach out if you have questions.
What We Offer
eViRis Health gives you access to pharmacy delivery, home diagnostics, and home nursing care. A few things worth keeping in mind when you use us:
- We're not a replacement for emergency care — if it's urgent, please call emergency services
- The more accurate the health information you share with us, the better we can serve you
- Healthcare outcomes depend on many factors — we can't guarantee specific results
- Please follow the guidance of the healthcare professionals involved in your care
Platform Role and Third-Party Services
eViRis Health is a technology and service coordination platform — a marketplace that connects you with independent third-party providers, including licensed pharmacies, diagnostic laboratories, nursing service providers, logistics partners, and payment service providers. eViRis Health itself does not manufacture medicines, operate laboratories, or employ the nurses and technicians who visit your home.
When you place an order or book a service through our platform, the contract for that service is directly between you and the relevant third-party provider. eViRis Health's role is limited to facilitating the connection and coordinating the fulfilment. Product availability, quality of service, timelines, and statutory compliance remain the responsibility of the respective provider, subject to applicable law.
All third-party providers on our platform are required to comply with applicable laws and are governed by separate Partner Terms and Service Level Agreements with eViRis Health. If you experience any issue with a provider's service, please reach out to us at hello@evirishealth.com and we will do our best to help.
Prescription Medications and Scheduled Drugs
The dispensing of prescription medications through our platform is governed by the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945. Here's what you need to know:
- Schedule H and H1 drugs require a valid prescription from a registered medical practitioner. A valid prescription must include the doctor's name and registration number, patient name, date, and the drug name, dosage, and duration. We will ask you to upload a clear photograph or scan of the original prescription before your order is processed.
- Schedule H1 drugs — which include certain high-risk antibiotic classes such as fluoroquinolones, third-generation cephalosporins, carbapenems, and specified antivirals — are subject to additional review by our pharmacist partners in accordance with applicable regulatory guidelines.
- Schedule X drugs (certain psychotropic and narcotic substances regulated under the Narcotic Drugs and Psychotropic Substances Act, 1985) are not available through our platform under any circumstances, in line with Rule 65-A of the Drugs and Cosmetics Rules, 1945.
- All dispensing is performed by registered pharmacists holding valid licences under the Pharmacy Act, 1948. Prescription records are retained by our pharmacy partners in accordance with Rules 64 and 65 of the Drugs and Cosmetics Rules, 1945.
Drug information shown on our platform — such as dosage, indications, and side effects — is for general reference only and is not a substitute for advice from your treating doctor or pharmacist. Please always follow their guidance for your specific health situation.
Ordering and Delivery
When ordering medications or booking services through our platform:
- You must provide a valid prescription for all prescription medications
- You agree to pay the prices displayed at the time of placing your order
- Delivery timelines are estimates and may vary based on your location and stock availability
- You are responsible for ensuring someone is available to receive the delivery
If your prescription is found to be invalid or incomplete after an order is placed, the order will not be processed. Any payment already made will be refunded in line with our Refund Policy.
Cancellations and Returns
Our full cancellation and return conditions are set out in our Refund Policy. The key points are:
- Medication orders can be cancelled before they are dispatched from the pharmacy. Once dispatched, cancellations are subject to the pharmacy partner's applicable return policy.
- Opened, used, or partially consumed medications cannot generally be returned, for patient safety and hygiene reasons.
- Schedule H, H1, and temperature-sensitive medications are non-returnable once delivered, unless there is a quality defect or a fulfilment error on our part.
- For home nursing and diagnostic appointments, you may cancel or reschedule at no charge up to 2 hours before the scheduled visit. Cancellations made within 2 hours of the appointment may attract a cancellation fee, which will be communicated to you at the time of booking.
- If a nurse or technician cannot attend for reasons within our control, we will reschedule your appointment at no additional cost or issue a full refund — whichever you prefer.
Medical Disclaimer
Information provided through our website or app is for general healthcare support and does not replace professional medical judgment. Our services are not intended for emergency care. For emergencies, please contact local emergency services immediately.
You are responsible for consulting qualified medical professionals and for using medicines only as prescribed. eViRis Health does not guarantee clinical outcomes.
Home Nursing and Diagnostic Services
Home nursing and diagnostic services are delivered by third-party partner organisations who engage qualified and trained professionals. The nurses, phlebotomists, and technicians who visit your home are employed or contracted by these partner organisations — not by eViRis Health directly. Clinical judgment during a home visit remains with the attending professional and, ultimately, with your treating doctor.
Diagnostic test results are generated and validated by our accredited laboratory partners. Results are shared for informational purposes and should be reviewed and interpreted by a qualified clinician in the context of your full medical history. eViRis Health does not independently validate test results and is not responsible for clinical decisions made based on those results.
Adverse Drug Reactions
If you experience an unexpected or adverse reaction to any medication received through our platform, please seek medical attention immediately and let your doctor know. We also ask you to report the reaction to us at hello@evirishealth.com — this allows us to document the incident and, where required, report it through the Pharmacovigilance Programme of India (PvPI), which is run by the Indian Pharmacopoeia Commission under the Central Drugs Standard Control Organisation (CDSCO).
Reporting adverse drug reactions helps protect other patients and supports national drug safety monitoring. Every report matters.
Your Account
Some features require you to create an account. When you do, you're responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and up-to-date information
If an account is being used in a way that violates these Terms, we may suspend or close it. For details on how we handle your personal data, see our Privacy Policy.
Acceptable Use
You agree not to:
- Use the platform for unlawful, fraudulent, or misleading activity
- Upload false, forged, or invalid prescriptions or medical records
- Interfere with platform security, availability, or integrity
- Attempt unauthorised access to accounts, systems, or data
Uploading a forged or false prescription is a criminal offence under the Drugs and Cosmetics Act, 1940 and may result in immediate account termination and referral to law enforcement.
Intellectual Property
All platform content, trademarks, branding, design, software, and related materials are owned by or licensed to eViRis Health and are protected under applicable intellectual property laws. You receive a limited, non-exclusive, revocable licence to access and use the platform for personal, lawful purposes only.
No Guarantees on Availability
We work hard to keep things running smoothly, but we can't promise the platform will always be available or entirely free from technical issues. Our services are offered as-is and as-available, without warranties of any kind to the extent the law allows.
Drug information on our platform — dosages, indications, interactions — is for general reference. It's not a substitute for your doctor or pharmacist's advice, and we can't guarantee it's always complete or current.
Our Liability
To the extent permitted by law, eViRis Health is not liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, business, or goodwill
- Any damages arising from your use of, or inability to use, our services
- Actions or omissions of third-party service providers accessed through our platform
Where liability cannot be excluded by law, our total liability to you for any claim arising from your use of our services will not exceed the amount you paid to eViRis Health for the specific transaction giving rise to the claim, or ₹1,000 (Indian Rupees one thousand), whichever is higher.
Indemnity
You agree to indemnify and hold harmless eViRis Health, its affiliates, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses arising from your misuse of the platform, violation of these Terms, or infringement of any third-party rights.
Regulatory Compliance
eViRis Health and its service partners operate in compliance with applicable Indian laws and regulations, including:
- Drugs and Cosmetics Act, 1940 and Rules, 1945 — governing the sale, stocking, and dispensing of medicines
- Pharmacy Act, 1948 — requiring all dispensing to be performed by registered pharmacists
- Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 — protecting your rights as a consumer, including your right to approach consumer dispute redressal forums
- Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 — governing our obligations as an online intermediary
Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2019 or any other mandatory consumer protection legislation applicable to you.
Suspending or Closing Access
If we have reasonable grounds to believe an account is being misused, involved in fraud, or violating these Terms, we may restrict or close access — temporarily or permanently. We don't take this lightly, and we'll act only when there's a genuine reason to.
Changes to Terms
We may update these Terms from time to time. When we make significant changes, we'll let you know by posting a notice on our website or sending you an email. Continuing to use our services after those changes means you accept the updated Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. The courts at Hyderabad, Telangana shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms — subject to any mandatory dispute resolution process required by applicable law, including your right to approach consumer dispute redressal forums under the Consumer Protection Act, 2019.
Force Majeure
eViRis Health shall not be liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, government actions, network failures, labour disruptions, or other force majeure events.
If Part of This Doesn't Hold Up
If any part of these Terms turns out to be invalid or unenforceable, everything else still stands. Sections that should logically outlast the relationship — like liability, indemnity, intellectual property, and governing law — remain in effect even if you stop using eViRis Health.
